Terms of Service

by commissioning me you are agreeing with the terms listed below.
certain terms can be changed or adjusted through a mutual agreement established prior to the commission.
i. general terms
To submit a commission inquiry, please fill out my commission form. Inquiries sent via private messages will not be accepted.
The submitted form must be properly filled out and contain the information that is requested.If an insufficient form is submitted, the inquiry will not be accepted.
Please make sure your submitted information is clear and concise, accompanied by suitable visual references.
More detailed information on submitting an inquiry is available here.As a main subject of the commission, I will NOT do:
★ explicit nsfw
★ mecha
★ gore
I retain the right to reject a commission for any reason.ii. payment
The payment for the commission must be made within 72 hours after the commission inquiry is confirmed and accepted, unless agreed otherwise.
All payments must be finalized before I start the commission - I will only begin working on the sketch once I receive and confirm the payment.The only currency accepted is USD.Payments are processed through PayPal invoices or Ko-Fi.I do not accept any payments without me explicitly confirming your commission and requesting it.If you send me unsolicited funds I bear no responsibility of refunding them for any reason.Payment plans are available upon request - you will receive an invoice with partial payments enabled and you will be free to pay in any amounts and frequency that suits you. No work on the commission will begin until the invoice is paid in full.
If the client cannot complete their payment plan by the established deadline, they may do one of the following: request an extension on the deadline; or change their commission request to fit the value of the payments that have already been deposited.
iii. extra fees
In addition to the base price, certain fees may apply:
★ Extra characters within the same illustration are for an additional 85% of the base price.
★ Large props (small pets, handheld items, etc.) are + 20 usd.
★ Very large props (approximately the size of the character themselves) are + 30 usd.
★ Fees for complicated character designs.
Some terms for fees differ in the case of Emotes, Alerts, and Live2d models. Please refer to their pricing details for more information.iv. revisions and delivery
You will receive a sketch of the commission and have the opportunity to request any changes and edits, as well as to check that I didn’t omit any details from your inquiry.
I won’t be making changes that go against or aren’t included in the inquiry established prior to the payment.The sketch is the only scheduled update and revision opportunity that you will receive. I won’t be sending any more updates until its completion, but if you want to check in on the progress, feel free to contact me!When I turn in my final version you still have the opportunity to request minor edits such as color adjustments.The deadline is set prior to the payment process. By proceeding with the payment you confirm that you are aware of and agree with the set deadline. A sooner deadline can be set for an extra rush fee, but its availability is limited and not always possible.Commissioned work is delivered through Google Drive - you will receive a link to a shared
folder that will contain the files.
v. copyrights and general usage
Signatures:

The artwork will include a subtle signature that you are not allowed to remove.
Stream assets are the only exception where you’ll be provided
with a non-watermarked version.
As the artist, I:
Retain all copyrights over the commissioned work.
Have the right to reject any order that I do not feel comfortable drawing for any reason.
Have the right to cancel a commission and offer a refund if I am unable to
complete the order for personal reasons.
Can post the final version of the drawing on my social media and use it as a sample for my commissions.
Will not further profit from the commissioned work.
If you do not want me to share your commission publicly, please let me know ahead of
time.
The buyer is allowed to:
Use the artwork for personal use.
Use the artwork to promote themselves on social media, including Twitch and Youtube promotional usage.
Print the artwork for personal use - as long as they’re not making monetary gains off of the work, they are free to make prints, stickers, etc. for themselves or others.
The buyer is NOT allowed to:
Reproduce/use the copyrighted artwork commercially, ie. making money off it in any way without purchasing the commercial rights.
Claim the artwork as their own.
Remove my signature from the artwork.
Alter the artwork without my consent, excluding alterations necessary for implementing animation to the artwork.
a breach of any of these terms will be considered copyright infringement and the commissioner's rights to the artwork will be retracted.
vi. commercial usage
Commissioning me for an artwork doesn't grant the buyer rights to further monetize my work. To acquire those rights an additional commercial fee must be paid.
A commercial fee generally costs from 50% - 300% of the price of the commissioned work, depending on the scale of the commercial purpose and the work in question. For more information please contact me privately.
The commercial fee may be purchased separately of the artwork, ie. you may commission me for a personal work at first and then pay the fee at a separate time, once you make the decision that you'd like to use it for commercial purposes.
If the client is an individual, not a company, they are free to use their commissioned work for promotional purposes without having to pay the commercial fee. Credit must always be easily accessible to the viewers of such promotional content.
Buyers may use their commissioned artwork for streaming purposes without paying the commercial fee. I do not consider streaming activity as commercial usage.Examples of work usage for which the commercial fee must be paid:
promotional usage for a company; printing the work on a physical object and then selling the product (stickers, apparel, cases, prints, etc.); restricting the view of the work by a paywall; or any other scenario that requires a payment to be made in order to gain access to the work, or products featuring it.
vii. cancellations and refund policy
I do not accept refunds - a cancellation of a commission will not be accepted if the payment has already been made. This also applies if the client is paying through a payment plan and any partial payments have been sent.
If the client cannot complete their payment plan by the established deadline, they may do one of the following: request an extension on the deadline; or change their commission request to fit the value of the payments that have already been deposited.
If you file a chargeback against me, your rights to the commissioned work will be retracted and you will be blacklisted and prohibited from commissioning me again. Your name will also be made public as a warning for others in the community.If the final work has not been delivered within 2 months past the initial estimated delivery date, the client will be offered to claim a full or partial refund, per the agreement that we'll come to. Unless a refund is issued, I remain obligated to deliver the commissioned work in its entirety.If the sketch for the commission has already been completed, only a partial refund may be claimed. No refunds may be claimed after the final work is delivered.any breach of my terms or copyright infringement will result in the commissioner's loss of all rights to the commissioned artwork and they will be blacklisted.if the rights to the work are retracted from the buyer, i have the right to resell and further profit off of the work however i deem fit.
